When you hang to convey a loud message


It is Gabbar Singh in Sholay who sends dead body of son of a blind maulvi back on mule to village as a warning. You hang someone to convey a loud message that India is not a soft target and cross border terrorism will not be tolerated at any cost. So you hang though you know that Afzal or Yakub were not main culprit but as message is more important than truth or innocence of a person so you hang him. So you kill principle of ‘satyamen Jayate’(Truth shall prevail') first and hang later.
All the institutions of modern state evolved gradually as a result of centuries of deep thinking by European thinkers, philosophers and jurists and everything is done under principles and procedures.
In Pakistan, Jamaat Islami has infiltrated all institutions and in India Sangh parivar has infilterated every institution so now in these two countries there are dedicated cadres first and administrators, lawyers, judges and doctors later.   So all these persons are betraying principles of their respective professions. They have no regard for principles and procedures evolved through hard thinking of centuries.

Then in this cadred government, someone at higher level decides something witty as perhaps he decided that Yakub will be hanged on his date of birth. Nature decided date of birth, he decided date of execution. So all formalities and procedures were to be completed before that. There was no value for procedures as outcome was already decided and so Judges will dispose the case in the night before and ot does not matter that family be informed as in case of Afzal and it does not matter whether last wish is fulfilled because date is fixed and everything is unimportant except the loud message. All processes and procedures become just farce/.

    This did not stop rapes n murders from happening since then
    Death penalty is based more on retribution and less on deterrence. It does not prevent future crimes from happening, only satisfies the feelings of a blood thirsty community.
